The Four Supplement Types Compared

Panel Track Supplements

A Panel Track Supplement is the most resource-intensive supplement type and is required when a proposed change is substantial enough that FDA may need to convene an advisory panel to review the new evidence. Classic triggers include a new indication for use that expands the intended patient population, a new contraindication, or a design change so fundamental that it alters the operating principle of the device and requires new clinical study data.

The Panel Track designation is FDA's determination, not the applicant's. However, applicants can seek input through the Pre-Submission program before filing to clarify whether a proposed change is likely to be routed as a Panel Track. Given the timeline implications — a 180-day target that often extends longer in practice when deficiency letters are issued — early FDA engagement is strongly advisable for any change of significant scope.

180-Day Supplements

The 180-Day Supplement covers a broad middle ground of changes that are meaningful enough to require FDA review and approval before implementation, but not so significant that an advisory panel is expected. Examples include changes to sterilization methods supported by new validation data, modifications to the sterile packaging system, new test methods for quality release, and substantial redesigns of components that do not alter the device's principle of operation.

FDA targets a 180-day review clock for these submissions, though applicants should plan for that timeline and build a change management buffer accordingly. Real-Time Supplements

Real-Time Supplements are reserved for minor changes accompanied by supporting data where the benefit-risk profile is well characterized and the change is not expected to introduce new safety signals. FDA targets a 30-day review for Real-Time Supplements and conducts an expedited review. Eligible changes typically include minor design modifications with well-controlled bench testing, limited labeling revisions, or component substitutions where the replacement is materially equivalent and supported by comparative data.

Companies should not reflexively classify a change as Real-Time to accelerate implementation timelines. The classification must be supported by a documented change assessment in the quality system. FDA reviewers can reclassify a Real-Time Supplement as a 180-Day Supplement if they determine the change warrants more extensive review, resetting the clock.

30-Day Notice for Manufacturing Site Changes

Post-Approval Studies: Ongoing Clinical Obligations

The PAS is not optional — it is a legally binding condition of the approval order.
